DISTANCE ELECTRONIC TICKET SALES AND PASSENGER TRANSPORTATION AGREEMENT

Hereinafter referred to as the "SELLER".

ARTICLE 1.2- BUYER:

The person who purchases the passenger transportation ticket via the "myroutetransfer.com" website, whose name appears on the ticket according to the information entered on this website, and to whom the passenger transportation service will be provided. Hereinafter referred to as the "BUYER".

In cases where the credit card holder and the person receiving the service subject to the ticket are different individuals; both the owner of the credit card used to pay the ticket price and the person receiving the service are the buyer side of this agreement. According to this agreement, both persons acquire the status of buyer and declare and undertake to fulfill the rights and obligations arising from this agreement.

The Buyer declares and undertakes that the information provided is accurate, that they will comply with all the rules specified in this agreement during the service provided, and that they will fulfill all obligations of this agreement.

ARTICLE 2- WEBSITE:

The address of the website through which the Seller sells the "passenger transportation ticket" under the terms of this agreement is "myroutetransfer.com".

All tickets reported to be sold by the seller outside of this website are invalid.

"myroutetransfer.com" shall hereinafter be referred to as the "website" in this agreement.

ARTICLE 3- SUBJECT OF THE AGREEMENT:

The subject of this agreement is to determine the terms and conditions regarding the sale of passenger transportation tickets made electronically by the SELLER to the BUYER via the myroutetransfer.com website and the passenger transportation service provided to the BUYER. In this regard, the provisions of the Law No. 4077 on the Protection of Consumers ("Law") and the Regulation on Distance Contracts dated 27.11.2014 ("Regulation") are taken as reference.

ARTICLE 4- INFORMATION AND DELIVERY OF THE GOODS/PRODUCTS/SERVICES SUBJECT TO THE AGREEMENT:

The services subject to this agreement consist of electronic ticket sales via the website regarding passenger transportation by vehicle and providing passenger transportation services to the buyer in whose name the electronic ticket is issued. The ticket consists of the seller's name, title, full address, telephone number, internet access information, MERSIS number, basic characteristics of the service subject to the contract, sales price, payment method, boarding point, destination, travel date, departure time, and the information available at the time the order is finalized on the seller's website. The ticket is also sent to the buyer's email address. The buyer is deemed to have RECEIVED the ticket subject to the agreement as soon as they finalize the ticket order specified in this contract via the website. Upon delivery, the buyer is deemed to have accepted and undertaken to comply with the rules in the agreement and to fulfill their obligations.

ARTICLE 5- UNDERTAKING AND RESPONSIBILITY OF THE BUYER:

The Buyer provides the necessary confirmation electronically indicating that they have read and are informed about the basic characteristics of the passenger transportation ticket subject to this agreement, passenger transportation rules, sales price, payment method, and all information regarding delivery. Upon purchasing the ticket, the buyer agrees and undertakes that they have read this agreement and passenger transportation rules, will comply with all rules in the agreement, and will fulfill all obligations.

The Buyer accepts and undertakes that in the event of failure to comply with the rules specified in this contract and failure to perform obligations in accordance with the rules, the seller may immediately terminate this agreement without any prior notice, reserving all rights.

All damages arising from the buyer's failure to comply with this agreement belong to the buyer.

Tickets purchased pursuant to this agreement are personal to the individual named on the ticket and can only be used in person. The Buyer accepts and undertakes the accuracy of the information entered on the website and that the ticket was purchased to be used by the person named on the ticket. If it is determined that the person named on the ticket and the person wishing to receive the service are different, the buyer accepts and undertakes that the seller has no responsibility arising from this agreement and can terminate this agreement without any prior notice.

ARTICLE 6- RIGHT OF WITHDRAWAL:

Due to the non-applicability of the articles written under the "Third Section" titled "Exercise of the Right of Withdrawal and Obligations of the Parties" of the Regulation to "Passenger Transportation Services", the BUYER does not have the right of withdrawal.

ARTICLE 7- RESERVATION, TICKET, AND TRANSPORTATION RULES:

1 – Tickets are personal and non-transferable to others.

2 – After the scheduled departure time, reservation changes, ticket cancellations, and fare refunds cannot be made.

3 – The passenger must present the credit card used for the purchase to officials during check-in (on the vehicle when receiving the boarding pass).

4 – The passenger agrees to comply with the vehicle order and the captain's instructions.

5 – The passenger must be present at the vehicle departure area at least 15 minutes before the vehicle departure time.

6 – The Seller reserves the right to make any changes to the trip schedule.

7 – Any dispute regarding transport shall be resolved in Kaş Courts in accordance with applicable tariff conditions and Turkish Laws and Legislation.

8 – Trips may be stopped, altered, or travel times extended due to problems arising beyond the control of the Seller. The Seller is not responsible for any expenses or inconveniences, including transportation, accommodation, and food expenses, that may arise from such delays and cancellations beyond the control of the Seller.

9 – Pregnant women whose pregnancy has exceeded six months travel in the vehicle entirely at their own risk and responsibility for their own safety.

10 – The Seller assumes no liability for any injury or death, or damage or loss to vehicles, luggage, or personal belongings, unless proven by the judicial courts in Marmaris to have resulted from the negligence or fault of the Seller. The Seller assumes no liability if injury, death, loss, or damage is caused by terrorism, riots, civil war, natural disasters, or malicious acts committed entirely by third parties.

11 – The carrier cannot be held responsible for passenger items lost in the vehicle.

12 – The ticket price covers transport only between the departure and destination points. Tickets can only be used for the route specified on them. Routes on tickets cannot be changed under any circumstances. Unless an additional fee has been collected by the seller, it does not cover any other services provided.

13 – If payment is made in a currency other than the declared currency, the evaluation will be based on the Central Bank Foreign Exchange Buying Rate at the time the electronic ticket was purchased.

14 – No specific seat number guarantee is given inside the vehicle.

15 – The Seller shall be liable only if the passenger or luggage suffers damage due to its own fault. If there is contributory negligence by the passenger, the seller's liability may be reduced or eliminated in accordance with legislative provisions.

16 – The Seller shall not be liable for loss or damage to fragile and perishable items, money, jewelry, precious metals, silverware, negotiable papers, or other commercial securities, passports, and other identification documents or copies contained in luggage.

17 – In the transportation of a passenger whose age, mental, or physical condition poses a danger or risk to themselves, the seller shall not be held liable for any illness, injury, disability, or death of such passenger resulting from or aggravated by these conditions.

18 – To facilitate your check-in procedures in the vehicles, please do not forget to print out your online ticket.

ARTICLE 8- REFUSAL AND LIMITATION OF TRANSPORTATION:

The Seller may refuse to transport a passenger and/or passenger luggage for safety reasons or at its discretion in the following and similar cases:

  • Passenger behavior, age, or mental/physical condition,
  • If requiring special assistance from the seller,
  • If causing discomfort and objections from other passengers, or posing any risk or danger to other persons or property,
  • If the passenger's failure to follow the seller's instructions makes such refusal necessary,
  • If the passenger refuses a security check,
  • In cases where passengers are under the influence of intoxicating substances and/or drugs, or arrive at the boarding terminal in a state that affects the safety and comfort of other passengers and the voyage,
Passengers who are refused transportation will not be refunded the ticket price by the seller, and no compensation will be paid in any manner.

ARTICLE 9- ITEMS NOT ACCEPTED AS LUGGAGE:

1 – Carrying firearms and ammunition other than those used for hunting and sports purposes as luggage is prohibited. Firearms and ammunition for hunting and sports purposes may be accepted as checked luggage to the extent that they comply with carrier rules. Firearms must be unloaded, on safety, and properly packaged.

2 – The Seller may refuse to carry any object as luggage due to its size, shape, weight, and nature.

3 – Unless placed in bags, suitcases, or other suitable containers to ensure safe transport with normal care, the seller may refuse to carry the luggage.

4 – Passengers are entitled to a free luggage allowance.

5 – Passengers can receive their luggage at the destination point after all luggage has been unloaded from the vehicle.

6 – Illegal substances such as drugs are strictly forbidden to be transported. If detected, all responsibility lies entirely with the carrier/person carrying them.

ARTICLE 10- TRANSPORTATION OF ANIMALS:

1 – Animals such as dogs (excluding dangerous dogs such as American Pitbull Terrier, American Staffordshire Terrier, Bull Terrier, Staffordshire Bull Terrier, Japanese Tosa, Dogo Argentino, Doberman, Rottweiler) and cats possessing valid vaccination and health certificates, entry permits, and other documents requested by Greece may be accepted for transport provided that prior agreement is reached with the seller.

ARTICLE 11- TRIP CANCELLATION AND REFUND TERMS:

1 – Changing passenger, date, time, and route details of electronic tickets purchased under this agreement cannot be requested from the seller under any circumstances. The Buyer accepts and undertakes that after sales confirmation, they will not change or request a refund for the ticket purchased in accordance with this agreement.

ARTICLE 12- WEBSITE TERMS OF USE:

1 – All rights and authority over the website subject to this agreement belong to Baş Damla Turizm Taşımacılık Tarım Hayvancılık Gıda İnşaat Ticaret İthalat İhracat Limited Şirketi (myroutetransfer.com), and any person entering and using the site is deemed to have accepted the usage and contract rules of the site. Baş Damla Turizm Taşımacılık Tarım Hayvancılık Gıda İnşaat Ticaret İthalat İhracat Limited Şirketi (myroutetransfer.com) reserves the right to change any information on the site, including contract terms. Changes take effect as soon as they are published on the site.

Article 13.5

The BUYER must not share credit card details with others. The BUYER accepts that they alone are personally responsible for the security of this information and that the SELLER shall in no way be responsible for the use of credit card information by anyone other than themselves. The BUYER agrees and declares that the SELLER has no direct or indirect liability for any negligence or fault regarding the security, storage, keeping away from third parties' knowledge, or use of credit card details, and to compensate for any damages incurred by the SELLER due to their negligence or fault.

ARTICLE 14- AUTHORIZED COURT AND APPLICABLE LAW:

Turkish Law shall apply to disputes that may arise from this agreement.

Marmaris Courts and Execution Offices are authorized to resolve disputes.

ARTICLE 15- AMENDMENTS:

Baş Damla Turizm Taşımacılık Tarım Hayvancılık Gıda İnşaat Ticaret İthalat İhracat Limited Şirketi (myroutetransfer.com) may change part or all of these transportation rules when deemed necessary.

ARTICLE 16- PROVISIONS:

Upon completion of the order, the BUYER shall be deemed to have accepted all conditions of this agreement. The invalidity or unenforceability of any provision contained in this 16-article agreement shall not affect the validity of the remaining provisions of the agreement.
